The agreement between FND and the organization that buys a pass.

In short

You buy a fixed-term pass, nothing auto-renews, and the price you see is the price you pay.

We run the platform; you stay responsible for supervising your participants.

For GDPR you are the controller and we are the processor, under the agreement at /dpa.

Belgian law, Belgian courts, and one refund per organization within 14 days.

Definitions

Organization
The camp, hotel, school or other operator that buys a pass and approves its own staff and participants.
Participant
A person verified by an Organization who uses the FND app inside that Organization.
Staff
A person an Organization approves to run activities and moderate its FND world.
Pass
A one-time purchase that opens FND for one Organization for a fixed term: one session or one year.
Cabinet
The web dashboard where an Organization's director manages the pass, staff and settings.
  1. 1.Who we are

    FND (Find 'n Do) is built and operated from Belgium. The full company block, including registration details and the address for legal notices, is printed at the bottom of this document and on /trust.

    1. 1.1Written notices to us are valid by email to the contact address published on this site.
    2. 1.2We answer contract and privacy mail within one business day, and never later than five.
  2. 2.The service

    FND is a verified-only activity platform for Organizations: an iOS app for Participants and Staff, plus a web Cabinet for directors. FND Web for Participants is in development and is not part of what you buy today.

    1. 2.1The platform shows what is happening now inside one Organization, and lets Participants join in one tap.
    2. 2.2Nothing in FND is public. There is no discovery of Organizations, no open sign-up and no cross-Organization visibility.
    3. 2.3Features are added over the life of a Pass at no extra cost. We do not remove a feature a Pass was sold on without notice.
  3. 3.Accounts and access

    Participant access requires physical presence at a partner Organization and verification by its Staff. There is no way into an Organization's world from the outside.

    1. 3.1The Organization is responsible for the Staff it approves and for withdrawing access when a person leaves.
    2. 3.2Team codes are credentials: an Organization that shares one outside its team carries the consequences.
    3. 3.3We may verify that an Organization is what it claims to be before opening a Cabinet.
  4. 4.What the Organization is responsible for

    FND is a tool inside your operation, not a substitute for it.

    1. 4.1Collecting the consent it needs from participants and, for minors, from parents or guardians. See /children.
    2. 4.2Supervising its participants in the physical world at all times.
    3. 4.3Moderating its own world: reviewing reports, removing content, restricting people who do not belong there.
    4. 4.4Keeping its participant list current, and closing the world when a session ends.
  5. 5.Payment

    Organizations pay by card through Stripe Checkout. Passes are one-time purchases for a fixed term. Nothing auto-renews, there is no hidden charge and no usage-based billing.

    1. 5.1Prices are shown including any VAT that applies, before you confirm.
    2. 5.2The Cabinet opens the same minute the payment succeeds.
    3. 5.3We do not sell by invoice. The only alternative to card payment is a written partnership agreement on individually agreed terms.
    4. 5.4A failed or reversed payment closes the Cabinet until it is settled.
  6. 6.Refunds

    A first purchase can be refunded within 14 days if the Pass has not been materially used. Refunds are one per Organization: after a refund, any later purchase is final.

    1. 6.1We may decline a refund where we see abuse: repeat purchase-and-refund cycles, a Pass consumed by a live season, or a violation of these terms.
    2. 6.2Refunds are paid back to the card that paid, within ten business days of approval.
  7. 7.Acceptable use

    No harassment, no impersonation, no sexual content, no content that does not belong at a camp, no scraping, no attempt to reach another Organization's world.

    1. 7.1Reports are reviewed. Repeat offenders are restricted automatically.
    2. 7.2We may remove content and restrict accounts without prior notice where a person is at risk.
    3. 7.3Automated access, load testing and security testing require our written permission first. Responsible disclosure is welcome: see /security.
  8. 8.Content and rights

    Participants and Organizations keep every right in what they upload. We store and display it only to run the service inside that Organization.

    1. 8.1We do not use partner content to train models, and we do not sell or share it for advertising.
    2. 8.2We do not use participant photos in marketing. Any promotional use of an Organization's material happens only with that Organization's written permission, case by case.
    3. 8.3The FND name, app and interface remain ours. A Pass grants use, not ownership.
  9. 9.Availability and support

    We aim for 99.5% monthly availability outside announced maintenance, and we publish incidents rather than hide them.

    1. 9.1Maintenance that requires downtime is announced at least 48 hours ahead and scheduled outside European daytime where possible.
    2. 9.2Support runs by email on Belgian business days. During a partner Organization's live session we answer urgent mail every day.
    3. 9.3This clause is a commitment to how we operate, not a service credit scheme. If we cannot run your season, the fair remedy is your money back for the unused part of the term.
  10. 10.Suspension

    We may suspend an Organization's access where there is a credible risk to participants, unpaid or reversed charges, or a serious breach of these terms.

    1. 10.1Except where a person is at immediate risk, we warn first and give a reasonable chance to fix the problem.
    2. 10.2A suspension for our own convenience does not exist: if we end a relationship without cause, we refund the unused part of the term.
  11. 11.Liability

    FND supports supervision, it does not replace it. The Organization remains responsible for the safety of its participants at all times.

    1. 11.1Our total liability under these terms is limited to what the Organization paid us in the twelve months before the claim.
    2. 11.2We are not liable for indirect or consequential loss, lost profit or lost data beyond our own backup obligations.
    3. 11.3Nothing here limits liability for fraud, wilful misconduct, death or personal injury caused by us, or anything else that Belgian law does not allow to be limited. Consumer rights, where they apply, are untouched.
  12. 12.Data processing

    For GDPR purposes the Organization is the controller and FND the processor of participant data. Our Data Processing Agreement at /dpa is part of these terms.

    1. 12.1A countersigned copy with your organization's details can be generated in two minutes at /dpa/sign.
    2. 12.2The current sub-processor list is at /subprocessors, with 30 days' notice before it changes.
    3. 12.3Retention periods are published at /retention.
  13. 13.Term and termination

    A Pass runs for its fixed term and then simply stops. There is nothing to cancel.

    1. 13.1An Organization may stop using FND at any time; a term already paid is not refunded outside clause 6.
    2. 13.2After a term ends we keep the Organization's data for the period at /retention, so a returning camp does not start from zero, and then delete it.
    3. 13.3An Organization can require immediate deletion at any point by writing to us. We confirm in writing when it is done.
  14. 14.Changes to these terms

    We may update these terms. Material changes are announced to partner Organizations by email at least 30 days in advance, with the previous version kept available for comparison.

    1. 14.1Every version carries a number and a date, listed in the change log at the bottom of this document.
    2. 14.2If a material change is unacceptable to an Organization mid-term, it may end the term and receive a refund for the unused part.
  15. 15.Governing law

    These terms are governed by Belgian law. Disputes go to the courts competent for our registered seat, unless mandatory consumer rules give a party the right to another court.

    1. 15.1The English version prevails if a translation and the English text disagree.
    2. 15.2If a clause is unenforceable, the rest stays in force.
